Please read these Terms of Service carefully before using StarWhisper. By downloading, installing, or using StarWhisper, you agree to be bound by these terms.
By downloading, installing, accessing, or using StarWhisper ("the Software" or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.
These Terms constitute a legal agreement between you and StarWhisper ("we," "us," or "our"). Our Privacy Policy is incorporated into these Terms by reference.
StarWhisper is a voice transcription software application that converts spoken audio into text. The Software offers:
StarWhisper grants you a personal, non-exclusive, non-transferable, revocable license to use the free version of the Software for personal and limited commercial purposes, subject to:

Both Free and Pro tiers permit commercial use of transcriptions you create. You retain full ownership of your transcription output.

We do not collect, store, or claim any rights to your transcription content. When using local mode, your audio never leaves your device. When using cloud mode, your audio is processed by OpenAI and immediately deleted after transcription.
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
If you enable cloud transcription, your audio is processed by OpenAI. Your use of this feature is also subject to OpenAI's Terms of Use. OpenAI does not use API data for training purposes.
Account authentication is provided by Firebase. Your use is subject to Firebase Terms of Service.
Payment processing is handled by Stripe. Your payment information is subject to Stripe's Terms.

We may release updates to the Software. Updates are optional and can be downloaded manually from our website. We do not force auto-updates. You may continue using your current version, though we recommend updating for security and feature improvements.
Current pricing is displayed on our website and in the application. We may change pricing at any time, but changes will not affect existing paid subscriptions until renewal.
We offer refunds in accordance with applicable consumer protection laws. For subscription plans, you may cancel at any time; access continues until the end of your billing period.
Lifetime licenses provide access for the operational lifetime of the current major version of StarWhisper. We make commercially reasonable efforts to maintain the Service but do not guarantee perpetual availability.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
We disclaim all warranties, express or implied, including:
Transcription and any AI-generated output should be reviewed for accuracy, especially for critical or professional use.
StarWhisper is general-purpose dictation and transcription software. It is not a medical device, and it is not FDA-cleared, FDA-approved, CE-marked as a medical device, or otherwise certified for diagnostic, therapeutic, monitoring, or any other regulated medical use.
StarWhisper does not provide medical, clinical, legal, financial, or other professional advice. Output from the Software is informational only. The Software must not be used as the sole basis for any clinical decision, treatment plan, prescription, diagnosis, legal filing, contract, or other professional or safety-critical action.
If you are a clinician, attorney, or other licensed professional, you remain solely responsible for verifying the accuracy and appropriateness of any Software output before relying on it, entering it into a patient record or legal record, or sharing it with a third party. The Software does not replace clinical judgment, legal review, or any other professional review process required by your profession or jurisdiction.
Some features of the Software (including, without limitation, any local large-language-model summarization, draft note generation, or other generative-AI feature, whether marked Beta or generally available) produce draft suggestions only. These outputs may contain factual errors, hallucinations, omissions, biased phrasing, or content that misrepresents what was said in the source audio.
You are solely responsible for reviewing every AI-generated output and verifying its accuracy and appropriateness before relying on it, copying it into a patient record, legal document, or other authoritative system, or sharing it with any third party. We do not represent AI-generated output as medical-grade, legal-grade, or fit for any safety-critical purpose, and you must not represent it as such to any patient, client, or third party.
You are solely responsible for compliance with HIPAA, GDPR, state and provincial privacy laws, your local medical-records and bar-association rules, and any other regulatory framework that applies to your use of the Software. The Software's local-only architecture is designed so that audio and transcripts do not leave your device in Local Mode, which can simplify compliance, but the Software itself does not constitute compliance with any regulatory framework, and we do not represent the Software as "HIPAA-certified," "GDPR-certified," or as a regulated medical device. Where Cloud Mode is enabled by you, audio is transmitted to OpenAI for processing, and you are responsible for determining whether that transmission is permissible under the laws and policies that apply to your data.
We do not sign Business Associate Agreements (BAAs). If your compliance program requires a signed BAA from your transcription vendor, the Software may not be appropriate for your use case.
Features marked "Beta," "Preview," "Pilot," or similar are provided without warranty of any kind, may behave inconsistently, may be modified or removed at any time without notice, and are not subject to any service-level commitment. Pilot features may be enabled for specific accounts only and may be removed at the end of a pilot period.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
You agree to defend, indemnify, and hold harmless StarWhisper, its operators, and its affiliates from and against any third-party claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Software in violation of these Terms; (b) your use of the Software for any clinical, legal, or other professional purpose without the verification and oversight required by your profession; (c) your reliance on, or distribution of, any transcription or AI-generated output without independent verification; (d) your violation of HIPAA, GDPR, or any other privacy or healthcare regulation in connection with your use of the Software; or (e) any content you transcribe or generate using the Software.
Your use of the Software is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Software, you consent to our data practices as described in the Privacy Policy.
You may stop using the Software at any time by uninstalling it. To delete your account, contact us at support@starwhisper.ai.
We may terminate or suspend your access if you violate these Terms. Upon termination:
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Software after changes constitutes acceptance of the new Terms. For material changes, we will provide notice via email or in-app notification.
These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Zurich, Switzerland, unless otherwise required by applicable consumer protection laws in your jurisdiction.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and StarWhisper regarding use of the Software.
